Bouchard v. SERC Decision
On February 2, 2018, the Connecticut Supreme Court issued its decision on the Bouchard et al, v. State Employees Retirement Commission Class Action. Unfortunately, the Supreme Court has ruled against the Class and three named plaintiffs. To summarize the decision, the Supreme Court held that the statute of limitations began to run at the time plaintiffs and Class Members retired, i.e. the day you received your first pension check. Thus, every plaintiff and class member under the Bouchard, et al. v. SERC case’s statute of limitations had expired, long before the Longley decision.
We are all very disappointed by this decision, but we must respect the opinion of the Court which is the final word on this matter.
